Portugal seeks to strip immunity from Iraqi ambassador's sons over attack on teen

The twin sons of the Iraqi ambassador in Portugal accused of running over and brutally beating a 15-year-old to the verge of death last week may lose their diplomatic immunity in a case which has shocked the country.

Portugal's foreign minister, Augusto Santos Silva, said that his government has asked Iraq to waive the two 17-year-old brothers' right to immunity against prosecution and is currently awaiting a response.

"The Ministry of Foreign Affairs has told the Iraqi ambassador that to establish the facts in this case we need Iraq to waive diplomatic immunity," Mr Santos Silva said on national television on Monday, adding that he expected "full cooperation from the Iraqi authorities".

Before their identity and diplomatic status was established, the two sons of Ambassador Saad Mohammed Ridha were briefly detained by police in the town of Ponte de Sor after they had fought with local boy Ruben Cavaco.

They were accused of running over the 15-year-old in their car in the early hours of August 17 before kicking their victim in the head until he lost consciousness.

The twins Haider and Ridha told Portugal's SIC television channel that they were sorry for what they had done, admitting they had "lost control" after drinking large amounts of alcohol.



But the brothers claimed they had previously been attacked by a group of boys, including Ruben Cavaco, in a bar, where Haider was in the company of fellow students from Ponte de Sor's aviation school.
 
They showed TV viewers selfies which showed the apparent effects of having been hit in the face before they had fled.

Later, the boys claimed that they returned to the bar to retrieve lost personal items, when they bumped into Ruben Cavaco, who again became violent.

"I felt extremely insulted also because of previous attacks and could not tolerate any more. So I ran after him and started beating him," said Ridha. The brothers denied having run the boy over in their car.

The Iraqi Embassy in Lisbon put out a statement saying the boys had acted in "legitimate self-defence" after being "severely beaten by six people who assaulted and insulted them for being Arabs and Muslims". ​​

Ruben Cavaco was flown to a Lisbon hospital where he spent several days fighting for his life in an induced coma after having reconstructive surgery to his face. He has now reportedly left intensive care.

If the Iraqi government were to refuse Portugal's request, the only remaining option open to Lisbon would be to strip the ambassador of his status by declaring him persona non grata, an extremely aggressive diplomatic step.
